Cancellation Policy
Flat-Rate Projects
Situations do arise where clients decide to cancel Flat-Rate Projects they have initiated. Projects that are not activated and are canceled within 7 days of the initial purchase date may be eligible for a refund. After the seven days lapse, all deposits become non-refundable as outlined by our project proposals and agreements.
Grace Period
If you cancel your project within 30 calendar days of your deposit date, you may receive a credit toward future work for the portion of the deposit amount that Spark Creative determines to be not yet consumed by work performed on the project (includes planning, preparation, design, and development).
Completion Payments
As outlined by our project proposals and agreements, clients are only responsible to make completion payments if they have approved the final work product and wish to receive the project deliverables. Any payments made for Additional Scope Deposits or On Demand Support Billing related to additional scope, are nonrefundable.
Work Product Ownership
In the event of cancellation, all work product developed and materials contributed by Spark Creative or their 3rd party partners in the execution of the project will remain the property of Spark Creative, unless otherwise expressly agreed to. All content and materials developed or contributed to the project by the client or their 3rd party partners will remain the property of the client and/or those 3rd party partners.
Agreement
By making the Deposit Payment and initiating your project, you agree to the terms and conditions of the Project Agreement and our Cancellation Policy.
On-Demand Support
Situations do arise where clients decide to cancel On Demand Support projects/tasks they have initiated. As outlined by our On-Demand Support Service Agreement, clients are responsible to make payment in full for all work that meets the following criteria:
- they or their agents authorized
- AND that Spark Creative and/or their 3rd Party Partners performed
If we receive a cancelation request for work that has not yet been performed, we will cease activity immediately and of course, the unperformed work will not be charged.
Work Product Ownership
As with all work product produced by our On Demand Support service, all work produced for a project/task that ultimately is canceled, including source materials, is the property of the Client, and Spark Creative places no restrictions on their use, except for any materials licensed from a 3rd party (stock images, videos, fonts, etc).
Agreement
By signing up for our On Demand Support service and authorizing the support time for a support project/task, the Client agrees to pay-in-full charges derived from the performed services in the manner outlined by our On-Demand Support Service Agreement.
